  • How legislative changes can affect the pharmaceutical market

    The Ukrainian pharmaceutical market is facing a challenge that could radically change its structure. Against the backdrop of attempts to improve state regulation, the Verkhovna Rada is considering initiatives that carry significant risks to the stability of the industry. Discussion of these issues was the main topic of the 14th Pharmacy Summit of Ukraine, which took place on December 3.

    The summit participants, among whom were key market players and government representatives, expressed their readiness for a constructive dialogue to resolve the problems of drug availability. At the same time, legislative initiatives, in particular Bill No. 11493, are already causing serious concern. After its adoption as a basis in late November, MP Yulia Tymoshenko announced a possible "reformatting" of the entire pharmaceutical market, which could affect not only business, but also ordinary consumers.

    The summit discussed key aspects of pricing. According to experts, 74% of the final cost of medicines falls on the manufacturer, while distributors receive 10%, and pharmacies - 16%. Market participants emphasize that price reduction should start with manufacturers, because shifting the financial burden only to pharmacies is unfair and inefficient.

    The proposed changes in the draft law, in particular, quotas for drug supplies (no more than 15% for one buyer) and the introduction of a single electronic catalog, raise serious concerns. According to experts, such restrictions can create an artificial shortage of medicines, especially in regions where access to medicines is already problematic.

    The risk of quotas for medicines with special circulation conditions, such as vaccines and last-resort antibiotics, is especially critical. This can disrupt the logistics currently provided by the two main distributors. Limiting their capabilities may lead to staff reductions, warehouse closures, and disruptions in the supply of medicines, particularly in frontline areas.

    During the summit, Minister of Health Viktor Lyashko emphasized the importance of a transparent dialogue between the state and business. He emphasized that the reform of the pharmaceutical market should be based on cooperation with all participants in the process. Industry experts also called on the parliament to refrain from hasty adoption of changes. Medicines are a matter of life and health of millions of Ukrainians, so any reforms should be balanced, open, and aimed at ensuring the availability of medicines for every citizen, regardless of their place of residence.
