Ukrainian Parliament Adopts New Law on Consumer Rights Protection

The Verkhovna Rada passed the Law #6134 on the protection of consumer rights. The adoption of this law aims to align Ukrainian legislation with EU standards.

The new law addresses the deficiencies of the previous legislation adopted in 1991 and introduces several important measures. Firstly, it defines the concepts of an electronic trading platform (marketplace) and an electronic product comparison service (price aggregator). It also establishes the responsibility of these platforms and aggregators for providing accurate information about businesses selling products on their websites.

Additionally, the State Consumer Service now has the authority to approach internet service providers and request the restriction of access to unscrupulous electronic trading platform websites.

The law also empowers consumer associations to conduct research on the quality and safety of goods, works, and services in the consumer market, while offering assistance to businesses. Public consumer associations are exempted from paying court fees in cases related to the protection of consumer rights.

Other notable aspects of the law include the definition of the principles governing consumer rights protection in accordance with EU principles, extension of consumer rights protection to food products, and the definition of rights and obligations in e-commerce.

The law introduces various provisions to safeguard consumer interests and ensure fair practices in the market. It grants consumers the right to price reductions or refunds in cases where defects arise after repair, among other protections. These measures aim to enhance consumer rights and create a more transparent and equitable marketplace in Ukraine.
